I. Without the authorization of the patentee, the patent infringement of manufacturing, using or selling the invention or utility-model product or manufacturing or selling the design product for production or business purposes shall be governed by the People’s Court of the place where such product is manufactured; and the patent infringement of the invention, utility-model or design product with uncertain manufacture place by the People’s Court of the place where such product is used or sold.
II. Without the authorization of the patentee, the patent infringement of using the patented process for production or business purposes shall be governed by the People’s Court of the place where such user is located.
III. Without the authorization of the patentee, the patent infringement of licensing or entrusting other to exploit the patent shall be governed by the People’s Court of the place where the licensor or the trustor is located; and the joint patent infringement by the People’s Court of the place where the licensee or the trustee is located in case of the licensee or the trustee having exploited the patent.
Article 1 Prerequisite for Party B’s acceptance
Except for Party B’s waive in part or in whole, only when the following prerequisites are met will Party B agree to accept the above listed drafts:
(1) Party A has paid the security in accordance with the Agreement;
(2) Party A has paid acceptance commission and acceptance commitment fees according to the Agreement;
(3) Other guarantee means agreed upon in Article 3 hereof has become effective;
(4) Other prerequisites for acceptance agreed upon by the parties.
Article 2 Acceptance fees
(1) Acceptance commission is calculated in the proportion of 0.05% of face amount;
(2) Acceptance commitment fees are calculated in the proportion of 1% (not more than THREE months) or 1.25% (more than THREE months) of the difference between acceptance amount and security, and shall be paid off upon acceptance.
