Janet, what positions did you hold, and what companies did you work for before joining Metalor ?
Prior to joining Metalor, I was based in New York where I held the position of General Counsel and Chief Compliance Officer for Mitsui & Co. Precious Metals. I came to New York from Australia via Tokyo where I spent time with the major Japanese trading company, Mitsui & Co. In Tokyo, I was based in Mitsui’s corporate headquarters as a lawyer advising on major energy projects. I first practiced law in Sydney at an international law firm where I specialized in corporate litigation including insider trading, shareholder litigation, merger disputes and director fraud.
What motivated you to join Metalor ?
I find the precious metals industry unique and fascinating. Metalor was an obvious choice owing to its position as a world leader in this exciting and wonderful industry! I love a good challenge and the position as Group General Counsel owing to the diversity of Metalor’s business units and product range made it an easy sell. Importantly, I was impressed by the Metalor team and their vision for business. It has been a personal goal to advise such business leaders.
What are your main responsibilities at Metalor ?
As Group General Counsel, I am responsible for all legal issues in our global companies. The global legal and compliance team consists of seven people located in Europe, Asia and the USA. Without their support, I could not function but more importantly, Metalor could not! Special mention to them is deserved - Delphine Bourgeois (Switzerland), Nicolas Burgi (Switzerland) Carine Maalouf (Switzerland), Maureen Martowska (USA), Nicholas Speciale (USA), Helen Tan (Greater China) and Watanabe Tomofumi (Japan).
What are your main challenges at Metalor ?
One of my main challenges is to cope with an environment that is increasingly affected by regulatory issues and compliance, and with the fact that the precious metals industry is brightly in the spotlight. Another challenge is maintaining the right balance between, on the one hand, remaining vigilant and careful in how we manage risk and, on the other hand, being commercial and ensuring that the business has the opportunity to grow and expand properly.
What are your priorities for the coming months ?
My first priority is to promote the very strong resource that we have in the legal and compliance department. Another priority is the implementation of a truly global legal and compliance department and unified approach to service all the business units. For example, we don’t have standard terms and conditions and contracts throughout the company, and the review procedure for legal contracts has just been introduced. Whilst a significant amount of work still remains to be done here, we have made great progress in forming a model thanks to the hard work of the legal and compliance team during a global conference recently held in Switzerland.
I also cooperate closely with and represent Metalor in numerous industry organizations and professional associations. I am a member of the RJC (Responsible Jewellery Council) Legal Committee, the LBMA (London Bullion Market Association) Regulatory Affairs Committees, IPA (International Platinum Group Metals Association) Security Committee, OECD Working Group on the Gold Due Diligence and the ASFCMP (Association Suisse des Fabricants et Commerçants de Métaux Précieux = Swiss Association of Precious Metals Producers and Dealers).
Could you please explain why compliance is important for the Metalor Group ?
Compliance is a strategic issue for a company like Metalor. If we consider the profile we have on the market, the trust of our prestigious customers, our accreditations and certifications, and our brand name, it’s important to make sure that all these assets are legally maintained and protected internally and externally, and that all regulatory issues are scrupulously respected at all levels of the company and at all points in our supply chain. |
