根据《劳动争议调解仲裁法》第四十七条的规定,适用一裁终局的劳动争议案件有两类,一是小额案件,即追索劳动报酬、工伤医疗费、经济补偿或赔偿金,不超过当地月最低工资标准十二个月金额的争议;二是标准明确的案件,即因执行国家的劳动标准在工作时间、休息休假、社会保险等方面发生的争议。对于第一类案件,一般应当以当事人申请仲裁时各项请求的总金额为标准确定是否属于适用一裁终局的劳动争议案件。对于第二类案件,该类案件一般不涉及具体金额,主要是指因执行国家劳动标准而产生的争议。

In accordance with Article 47 of the Law on Mediation and Arbitration of Labor Disputes , the principle that the arbitration award shall be final and binding is applicable to two types of labor disputes. First are the small claim cases, including disputes in relations to the claim of labor remunerations, work-related injury medical expenses, economic compensation or damages which do not exceed the local monthly wage standard for an amount of 12 months. Second is the specific cases, referring to cases. Second are cases under definite criteria, including disputes arising from the enforcement of the state labor standards on working hours, rest, vocation and social insurance, etc. As to the first type of cases, whether the principle of final and binding shall be applied is determined by the total requested amount of the party when applying for arbitration. As to the second one, specific amount is usually not concerned and it mainly refers to disputes arising from enforcement of state labor standard. |
