This essay is mainly using literature studies, market surveys and case analysis. The author used temporal sequence as the clue, and made a general and systemic discourse for the history of development and the innovative route of Chinese tobacco advertisement.
The essay is divided into 4 chapters; there are “The history of Chinese tobacco advertisement”, “The present Chinese tobacco advertisement”, “and “The innovative route of Chinese tobacco advertisement”and“The innovation model of Chinese tobacco advertisement----analysis the brand of “Five gods” advertisement practice. The author is going to discuss the history of Chinese tobacco advertisement both in history and the present situation, and analysis the innovative route of Chinese tobacco advertisement both in theory and practice. The essay used “statement” as masterstroke, while make “discussion” interspersed in it.

挂面是一种传统的食物，长期以来受到消费者的欢迎，但是各品牌挂面包装一直难以突破它传统的包装模式，包装结构形式单一，在设计风格上缺乏个性和创意，难以在琳琅满目的同类品牌中脱颖而出，获得青睐。本课题以挂面包装造型、色彩以及图形上的突破为研究主题，在包装设计上突破传统挂面单一的包装模式,结合传统包装，融入时尚元素，打造一个现代、温馨、和谐的包装视觉形象，使包装更具有识别能力。
通过对市场的调查分析，更加明确了潜在消费群体，并针对这个群体对挂面包装进行了具体个性化的设计。 “善食汇”挂面包装的设计理念最终确定为“时尚而不失传统韵味”，在传统挂面包装上寻求新突破，在色彩应用上更为贴近消费者的喜好，在图形设计上更为简约，突出产品重点，塑造一个有个性的“善食汇”挂面包装新形象，个性化的包装设计可为人们在紧张的生活中添加轻松和幽默。希望通过完整的包装设计提升消费者对“善食汇”挂面的认知度、美誉度、信誉度，使挂面包装新形象深入人心。

Nowadays, with the abundant of commodities, the promotion tools and sales modes are introduced one after another, so package becomes a kind of visual images which contacted the most widely and frequently by customers in commercial activity. A good design packing of goods plays an important role on leading the consumes, enhancing the competitiveness of goods and establishing brand images.
Noodles is a traditional food which always very popular by customers in the long-run. However, all kinds of brands of noodles have difficulties making a breakthrough on their traditional mode of packages, there are every simple in the form of structure and lack of personality and creativity in the style of design, so it is difficult for them to stand out from the other brands of the same kind which have an eyeful of goodies, thus hard to be favored. This topic is going to use the breakthrough on the packages, colors and figures of noodles as the theme of research, breach the traditional simple modes of package for noodles, combine the traditional package with fashion elements to make a modern, warm and harmony package visual image, and let it take on more identification ability.
Through making marketing opinion surveys which make it clearer on potential consumer group, and in allusion to this group, a specific individual design has been made. The package of noodle “ShanShiHui” has finally confirmed its design ideas as “Fashion while not lack of traditional feeling”, to find new breakthrough on the basis of traditional noodles package. It is closer to the preference of consumers on the application of colors, more concise on the figures design, define priority of the product and mold an individual new image of “ShanShiHui” noodle package. An individual design of package can add relaxation and humor in people’s intense life. I hope that through completed package design to promote the awareness level, possessing and credit worthiness of “ShanShiHui” noodles in consumers’ minds, and make the new package image of noodles enjoy popular support.

举证时限制度源于西方的证据失权制度，在引入我国之后逐步改变了我国以往的证据随时提出的现象，举证时限制度是行政诉讼中的重要制度之一，其能够确立并完善主要是源于行政诉讼对于诉讼效率价值和程序公正价值的追求。虽然在行政诉讼中这项制度引进较早，但是在立法和司法实践中仍存在诸多问题，这主要是由于观念，价值取向和立法三方面的原因合力导致的。首先，在观念上，要转变对于程序正义和公平的错误认识，改变对证据失权的看法。其次，在价值取向上，作为立法者和司法部门应当以提高诉讼效率为出发点，以实现程序正义与实体正义的和谐统一为归宿制定并执行法律，把提高诉讼效率、诉讼效益、程序公正作为基础价值追求，最后，在立法方面要完善举证时限制度相关法律制度的查漏补缺工作，建立完善的举证失权体系，在上位法中明确内规定，使法官在审判过程中有法可依，是当事人服判息讼，同时还应完善相关的制度如证据交换制度，逾期罚金制度，更为重要的是完善审前准备程序，从而进一步提高诉讼效益，实现举证时限制度的良好运作和发展。

The Limitation of Evidential System was originated from the Evidence Lapse system in western countries. After being brought in our country, it gradually changed our phenomenon which presented by the evidence before. The Limitation of Evidential System is one of the most important system in administrative litigation. The reason why it can be established and completed is mainly owing to the efficiency values and justice procedure values which pursued by administrative litigation. Although this institution was brought in the early time in administrative litigation, there are still many problems existed in legislation and judicial practice. It is because of the composite force in concepts, value-orientation and legislation. Firstly, in concepts, it is advisable to transform the erroneous realization to the procedure justice, and change the point of evidence lapse. Secondly, in value-orientation, legislators and judicial departments should improve the efficiency of litigation, setting and dispensing justice in order to realizing the harmonious unity between procedures justice and substantive justice, making the improvement of litigation, lawsuit efficiency and procedures justice as a fundamental value. Lastly, in legislation, it must complete the work of defilement of the limitation of evidential and other relative systems to build a complete evidence lapse system, to clear the inner regulation in higher-level law, to make the judges have laws and regulations to abide by during the trial course., to make the litigant parties obey to the judgment and stop the litigation. Meanwhile, it is also advisable to complete the relative systems, such as the System of Evidence Disclosure, Late penalty System. Moreover, the pretrial procedure before the adjudgement is more essential in improving litigation efficiency and realizing the good practice and development of the Limitation of Evidential System. |
